Arts Commission

1. Does Federal Way have any public art?

Yes! The City of Federal Way has a number of pieces in the public art collection. Look for our brochure, which lists where public art can be found at the libraries, city-owned buildings and hotels. There are also other pieces of public art around the city. The transit center has several pieces, as well as many of our schools and libraries.

2. How can I join the Arts Commission?

To become a member of any commission in the city, watch the Federal Way Mirror for notices of openings. You can also check the City of Federal Way website for openings. Most commissions require that you live in the City of Federal Way.

3. Where does the commission get its funding?

The Arts Commission is funded by the city. We also receive a grant from 4Culture.

Bike and Pedestrian Plan

1. What is the CPPW Grant?

CPPW stands for Cities Putting Prevention to Work. The City of Federal Way was awarded a grant from Public Health Seattle/King County to develop a Bicycle Pedestrian Master Plan as part of a county-wide effort to increase physical activity in King County cities. This grant is funding the preparation of a city-wide Bicycle Pedestrian Master Plan. Other cities in King County are working on similar projects with CPPW grant funding. 2. How can I provide input to the master plan?

There are many ways to be involved with the development of the Bicycle Pedestrian Master Plan. You can join our mailing list for electronic updates and notifications of community meetings on the master plan. You can attend one of the community meetings and help develop plan alternatives that address your needs and issues. Business License

1. How long does it take to process a business license application?

Your business license application will be processed in approximately one to two weeks. This may take longer if your application is not complete, if your proposed use and/or tenant improvements require an inspection, if you are opening an in home business, or if you require a specialty license ( pawnbroker, 2nd hand dealer or security business).

2. Do I need a business license for the City of Federal Way?

The City of Federal Way Municipal Code requires every person conducting business within city limits to obtain a Federal Way business license. This includes home occupations and outside contractors that come into the city to do business. Federal Way Municipal Code 12.05.010

3. Do I need to obtain a master license with the state?

You need to register your business with the Washington State Department of Revenue for a master license if you can answer yes to any of the following questions:

• You are a buyer of specialty wood products


• You are required to collect sales tax


• You are required to pay taxes or fees to the Department of Revenue


• Your gross income is more than $12,000 a year

4. Are there any other licenses or permits required to operate a business in Federal Way?

The City of Federal Way only requires a city business license and a state master license with the Department of Revenue if applicable. If you are making tenant improvements or if the structure is a new building, you will need to contact the Community Development Department at 253.835.2607. If you are operating a restaurant or handling food you would need to contact the King County Public Health Department. If you serve liquor or have any gambling activity please contact the Washington State Liquor Control Board and the Washington State Gambling Commission to apply for the appropriate licenses.

5. What are the fees for licensing a business in the city?

The fee for a standard business license is $75. This includes regular, outside contractor and home occupations. The standard license is valid until the end of each year. The fee for a temporary business license is $50. A temporary business license is good for any 90 days in the calendar year and will expire at the end of the year. Any standard license that is issued within the last three months of the year will expire December 31st of the following year. Renewal notices will be sent to your mailing address in November of each year and are $50.00 for the standard license.

6. Does the city issue a solicitor's permit?

Yes, the city issues door to door solicitor permits or temporary licenses. Approved permits are good for 90 days and can be used any 90 days in a calendar year. Once issued, the permit must be carried with the person if traveling to different locations within the city.

7. Can I operate a business out of my home?

Home occupation licenses are issued if you live within the city limits and operate a business out of your home in compliance with all city codes and ordinances. Even if you do not run the business in your home (i.e., landscaper, plumber, etc.), it is still considered a home occupation. City Codes and Ordinances

8. Can I have a block party, parade demonstration, etc. on city property?

A right of way activity permit is required for any event that will temporarily block, impede or be held on any public right of way within the City of Federal Way. This type of license is issued to special events, block parties, races, demonstrations and organized rallies of any kind that occur on a street, sidewalk or other public property and consist of five or more persons or two or more vehicles. Before issuance, the application is routed for review to the streets department, public safety and the South King Fire and Rescue.

3. How do I address an issue with the City Council?

Public comment opportunities are available at regular City Council meetings. To speak at the meeting, a citizen must fill out a public comment sign-up sheet, available at the entrance. Once completed, it should be handed to the city clerk who is sitting at the end of the dais. Public comment is one of the first agenda items for each meeting.

4. Why isn't there more discussion of issues on the City Council agenda at their regular meetings?

The City Council has a number of meetings that it uses to complete work for the community. The council is divided into three working committees, which study issues prior to the regular council meetings. These meetings are held at City Hall and are open to the public. In addition, some of the action taken at council meetings starts with the hard work of the council’s various citizen volunteer commissions. These commissions often help mold issues as they work through city government. The three council committees are: Finance, Economic Development and Regional Affairs; Parks, Recreation, Human Services and Public Safety and Land Use and Transportation.

5. How do I tell the City Council about positive things that are happening in our community?

Code Enforcement

1. Is it ok to park on the lawn?

A vehicle needs to be parked in the driveway, garage, carport or on a legal parking pad and there must be direct driveway access to the parking area. Legal pads can now consist of grass but cannot be located in the area between the primary dwelling unit and the front property line, FWRC 19.130.246.

2. Where do I report junk in my neighbor’s yard?

3. My neighbor is building a shed in the backyard. What is allowed?

Sheds need to be detached, freestanding and under 200 square feet in order not to require a building permit. They also need to be out of the required setbacks which are usually 5 feet in the back and 5 feet on the sides.

4. I saw some graffiti today, where do I report that?

5. There is a crew cutting down trees in my neighborhood; whom do I call?

After hours you should call 9-1-1, but otherwise start with code enforcement staff to determine if there is a violation as there are new Tree-Ratio guidelines to follow in residential areas.Please call 253.835.2617.

6. What are my rights as a tenant?

Some problems are violations of our codes, but many issues for renters are civil matters and we cannot give legal advice, so please consult the Landlord Act online (RCW 59.18) and/or Mobile Home Landlord-Tenant Act (RCW 59.20).

7. Who picks up shopping carts?

Police Department volunteers go out once a week, and requests can be left at 253.835.6774. Stores should be picking up their own carts, however.

1. What time do the parks open and close?

Park hours are from dawn to dusk. Dawn is 30 minutes before sunrise, and dusk is 30 minutes after sunset.

2. Do you have an off-leash dog park?

French Lake Park is 10 acres in size, and has been fenced and double-gated to provide a secure place for owners and their dogs to romp, get the exercise they need and have fun off-leash. It is located at 31531 1st Ave. S. French Lake Park Rules

5. Can I reserve a park for large gatherings?

A Special Event Permit is required for any community, special or private event not sponsored by the city that requires other than routine use of any park or outdoor facility. 6. Where is swimming permitted?

Swimming is allowed in Steel Lake Park in the designated swimming area only.

Lifeguard hours are Monday through Thursday from 1:00 pm to 6:00 pm, Friday from 1:00 pm to 7:00 pm, and Saturday and Sunday from 12:00 noon to 7:00 pm. The lifeguards will be on duty starting June 18, 2011 and will end September 5, 2011.

7. Are campfires allowed?

Campfires are prohibited in all city parks.

8. Can we bring barbecues into the park?

Barbecues are allowed in the park. You must properly dispose of the hot ash. It is not to be dumped in tree wells.

9. Who do I call about a dead or leaning tree that's not on my property?

Call the City of Federal Way Parks Department at 253.835.2700. They will determine ownership of the property and proceed accordingly. If the tree is on property owned by Federal Way, it will be inspected and then a final determination made as to how the tree concern will be handled.

10. When is fishing season?

Fishing in Steel Lake Park is permitted from the last Saturday in April until October 31. For more information, visit the Washington Department of Fish and Wildlife website.

11. Who should I contact for Eagle Scout projects?

Due to limited staff, projects will be considered on a case by case basis. You may contact Parks and Facilities Supervisor Jason Gerwen at 253.835.6962.

12. Do you have a skate park?

The skate park is located at 2410 S. 312th Street.

13. Are fireworks allowed in city parks?

Fireworks of any kind are not allowed in any city park or recreation facilities.

14. Where can I camp overnight in Federal Way?

2. What supporting documents do I need?

You will need the following information:

Income verification for all income received by each occupant of your home which can be, but is not limited to, copies of last year’s tax return, social security, disability, pension, annuity or retirement benefit award statements. Bank statements are needed for July – December of the previous year.

If your home is a mobile or manufactured home, submit a copy of your Washington State Vehicle Certificate of Ownership. If a bank or institution is the legal owner, please send documentation showing you as the borrower and your mobile home as the property or collateral for the loan. Legal title of your home is required for program eligibility. A vehicle registration form is not proof of ownership. Please do not send vehicle registration forms with your application.

Proof of homeownership through mortgage paperwork.

Proof of current homeowners insurance.

Proof of being current on property taxes. An informational statement may be obtained by contacting the King County Treasury Operations at (206) 296-0923.

3. Is this a loan or a grant?

The Emergency Housing Repair program is structured as a 5 year forgivable loan program for homeowners within the city limits of Federal Way. This is a zero interest forgivable loan, forgiven at 20% for each year the applicant keeps the home as their primary residence. There is a Deed of Trust filed with the King County Auditor’s Office.

4. What types of repairs are generally eligible?

Eligible repairs include most emergency situations such as an inoperable furnace or hot water heater, potentially hazardous plumbing or electrical systems or water intrusion issues. Other issues that threaten the safety and/or health of the household are eligible. Staff will review each application for eligibility. Staff reserves the right to deny any or all of an application if it is determined to not meet our criteria for an emergency.

5. What types of repairs are not eligible?

Ineligible repairs include cosmetic improvements, routine maintenance, appliance repairs, repairs to separate porches, rooms, or garages, sidewalk repair, painting of interior or exterior surfaces, and other items that may be deemed ineligible by staff on a case-by-case basis.

6. What types of homes do you work on?

We work on single-family homes, townhomes, condos, and manufactured homes. Our only stipulation is that this must be your primary residence.

7. How much are the deferred loans and how often can I apply?

Currently, the deferred loan is a lifetime maximum of $5,000 per address and may be granted to correct emergency conditions. A person can apply multiple times until the $5,000 amount has been exhausted.

8. What happens if the repair is over $5,000?

If the repairs are over $5,000, The City of Federal Way can make an exception. Staff would discuss the project with the homeowner to determine if the project is eligible for the increased amount. Examples of exceptions are roofing issues or ADA accessibility items.

9. Who approves my application?

Your application is reviewed by staff and the Community Services Manager who will then make a decision on your application.

10. I was denied. Is there an appeal process?

You may appeal the decision in writing by sending a letter or email to staff. It will then be reviewed by the Director of Community and Economic Development who will make the final determination.

11. How long does it take to approve my application for eligibility into the program?

Our goal is to have your eligibility evaluated within three weeks after the completed application and all supporting documents are received in our office.

12. I have lost some of my paperwork. What do I do now?

We suggest contacting your provider and asking for copies of the documents. Banks, insurance companies, and other providers generally will send these documents when asked. Unfortunately, we cannot process incomplete applications.

13. I live outside Federal Way in the potential annexation area, am I eligible?

At this time, we are only accepting applications from homeowners who live in the established City limits of Federal Way.

2. Does the City of Federal Way impose a Utility Tax?

The City of Federal Way imposes a tax on all utilities (except water and sewer) operating in the city at a rate of 7.75% (effective February 4, 2007). This includes a 1.75% tax increase voters approved at the November 2006 general elections to fund the Police and Community Safety improvement initiative consisting of 24 FTEs in police, prosecution, court, code enforcement, parks maintenance and related support functions. The utility tax is also used to fund capital improvement projects; including related maintenance and operations and general fund operations. All utility companies are required to file and remit a monthly utility tax return to the City of Federal Way at a rate of 7.75%.

3. Does the City of Federal Way impose a Gambling Tax?

Yes, if you conduct any gambling activity on the premises, you must first obtain approval through the Washington State Gambling Commission. In addition, any business authorized by the State Gambling Commission to operate social card games and/or expanded card room activities are required by the City to pay an additional $500 for a new or expanded license or during when a change in ownership occurs. The City license is renewed annually, with a fee of $100.

The City also requires a business to file and remit a monthly (or quarterly depending upon the annual amount of tax) gambling tax return to the City. To obtain quarterly filing status, an establishment must gross less than $10,000 in gambling revenues (based upon prior years history) and request a change with the Finance Department. The gambling tax return is due the last day of the month following activity.

4. Does the City of Federal Way impose a B&O tax?

The City of Federal Way does not impose a business and occupation tax. However, any business operating in the City of Federal Way is required to apply for and obtain a state business license and a city business license.

5. Is there a tax imposed on the sale of real estate in the City of Federal Way?

Yes, all sales of real estate are taxed at a rate of 1.78%, of which the city receives .5%, and 1.28% goes towards state funding of K-12 education and public works assistance. The receipts from this tax must be spent solely on capital projects contained in the City Capital Facilities Plan (CFP). The city uses this funding source for debt service payments on obligations incurred to finance these projects. Any excess Real Estate Excise Tax (REET) is available for capital purposes.

6. Who Audits the City of Federal Way's financial statements?

Under state statute, all county and local government entities are audited by the state of Washington auditors office. The state has a constituent referral program, whereby a citizen can report any observed illegal or inappropriate activities by an employee or agency. For further information on the constituent referral program or to review a copy of an audit report, see the state auditor's website. The City of Federal Way's MCAG # is 0711.

7. What type of financial reporting documents are prepared by the City?

The City of Federal Way prepares a biennial budget beginning in each odd year as well as interim financial reports on a monthly basis. The monthly financial reports (MFR) are reviewed by the Council Finance Committee each month and accepted by the full City Council at their first council meeting of each month.
The city also prepares a comprehensive annual financial report (CAFR) annually that is audited by the state auditor's office. This report is required to be completed by June 30th (six months after the last day of the end of the year). Audited reports are typically available in September of each year.

8. What is the Sales Tax Rate in the City of Federal Way?

The sales tax rate for businesses operating in the City of Federal Way is 9.5% rate effective 10/1/11. All businesses operating in the City of Federal Way must use tax code #1732 when filing their combined excise tax return with the State. The mayor’s office is open from 8:00 am to 5:00 pm, Monday through Friday.

2. How are the mayor and City Council members chosen?

Federal Way operates under a mayor-council form of government. Voters elect the mayor and each of the seven City Council members. Each council member represents the whole city rather than a specific district or neighborhood.

3. Can I get an appointment with the mayor?

For an appointment with the mayor, please call his office at 253.835.2402 for availability. If you want to discuss a particular issue, please supply relevant background material so the mayor will be prepared to discuss the issue with you.

4. Can I get the mayor to speak at my event?

Mayor Priest is pleased to address Federal Way civic and community groups, if his schedule allows. Many City Council members are available, as well. Please contact Communication and Grant Coordinator Chris Carrel at 253.835.2411 to request the mayor or a City Council member at a future event.

5. Does the mayor write letters of recommendation or congratulations?

Mayor Priest is happy to write letters of recommendation and congratulations, where appropriate. Please forward your request by email with a draft letter. He will edit it and put it on his letterhead with his signature. Please note that before the mayor will recommend someone with whom he is unfamiliar, however, he will want to have a conversation with them.

For letters of congratulations, please provide details about the purpose of the letter and the activities of the recipient, along with contact information. Please allow sufficient time prior to the date you need the letter.

5. What can I do with my children on non-school days?

When there's a no school day, your kids can hang out for the day at the Federal Way Community Center. There will be games, snacks, swimming, rock climbing and crafts. The cost is just $40 for the day. This service is for ages 6-12 years. Bring a swim suit, towel and sack lunch. Sign up at the Federal Way Community Center or visit their website.

Photo Enforcement Information

1. Is the law different in photo-enforced areas of Federal Way?

No. The law is the same at all intersections and in all school zones. Photo enforcement is simply a different method of enforcing the law.

2. What is the law at intersections regarding red lights?

If you are turning right, you must come to a complete stop before the stop line and you can then proceed with your turn if traffic is clear. A stop is defined as a “complete cessation from movement.” In other words, your vehicle cannot be moving at all. You must yield to other vehicles entering the intersection on a green light and vehicles making U-turns. If you are travelling straight through the intersection or turning left then you cannot pass the stop line after the light turns red.

3. What is the law in school zones?

The law varies depending upon what type of signage is present. Federal Way’s photo-enforced school zones use flashing yellow lights to signify the need to drive lower than the normal posted speed limit. The speed limit is reduced to 20 mph when the lights are flashing, regardless of whether children are present or not present.

4. Will a violation go on my driver’s record?

No. Photo enforcement tickets are treated the same as parking violations and will not appear on your driving record.

5. Why am I being cited as the registered owner of the vehicle?

The law provides a rebuttable presumption that the registered owner was the driver at the time the alleged violation occurred. Unlike some other states, Washington law prohibits a photograph of the driver. The type of presumption used in photo enforcement violations is the same type of presumption that has been used for parking violations for a number of years.

6. What if I was not driving the vehicle at the time of the alleged violation?

There is a presumption, provided by law, that the registered owner was the driver, but that presumption can be overcome with evidence that you were not driving at the time of the alleged violation. However, the judge is not required to believe you if there is some doubt about your credibility.

7. Am I required to name the person who was driving?

The law does not require you to name the other driver, but if you want to avoid a hearing then you can name the other driver in the Statement of Non-Responsibility provided to you with the Notice of Infraction. Otherwise, you need to request a hearing and present your testimony to the judge. The person who was driving may voluntarily accept responsibility.

8. What are the fines?

By law, fines cannot “exceed the amount of a fine issued for other parking infractions within the jurisdiction.” Parking fines in Federal Way can be as much as $250, with an additional $200 assessment. However, the fine for red light violations is only $124; the same amount charged if the citation was issued by an officer in your presence.

The fines in Federal Way for photo violations in school zones range from $210 to no more than $250 (excluding late fees). School zone violations issued by a police officer in your presence start at $210 and can be as high as $784.

9. Can the fine be reduced or waived?

Yes. You can request a mitigation hearing for all photo enforcement tickets and the judge can reduce the fine based upon the circumstances presented in your case. The fine will only be waived to prevent a gross injustice. By state law, the fine for school zone violations issued by a police officer in your presence cannot be waived, mitigated or reduced. However, photo enforcement fines in school zones can be waived, mitigated or reduced.

10. Can a photo enforcement ticket be deferred?

Defendants desiring to keep violations off their driving record request deferred findings. There is no reason to defer a photo enforcement ticket because the violation will never appear on your driving record.

11. What are my hearing options?

If you decide not to pay the fine, you can request a mitigation hearing or a contested hearing. The hearings can be in person or by mail. Please follow the directions on the information provided to you by the court in requesting a hearing.

Simply put, you should request a mitigation hearing if you do not contest the issuance of the ticket against you and want the fine reduced or waived. You should request a contested hearing if you do not believe you violated the law. Please note that you waive your right to appeal if you request a contested hearing by mail. Also, the judge typically does not reduce the fine if the judge determines that you committed the infraction.

12. How are the hearings conducted?

For a contested hearing, the judge will first look at the affidavit of the officer, photographs and the video. In the case of an in-person hearing, the judge will then put you and any witnesses you call under oath. You will then present your case. The judge will then make a decision. You have 30 days to appeal an adverse decision. In the case of a mail-in hearing the judge will review your submission and then make a determination. Remember, you waive your right to appeal if you request a contested hearing by mail.

For a mitigation hearing the judge will either hear from you first if you appear in person or read your submission if you submitted your case by mail. The judge may then review the evidence offered by the city. There is no appeal for a mail-in or in-person mitigation hearing.

4. Why haven't the plow trucks come to my neighborhood yet?

5. Why does the plow truck leave a berm of snow across my driveway?

Our goal is to clear the roadway for safe travel. Unfortunately, berming is an inconvenient result of plowing. Adjacent property owners are responsible for clearing the berm to gain access to the roadway. We do not have the available resources to provide this service, and this is one way you can help.

6. Why is the plow truck driving down the street with his plow up?

If the street was just sanded with the salt / sand mixture, the plow is trying to avoid removing any product that was just applied.

7. Why are the main roads bare and wet, while my neighborhood has compact snow and ice?

It has taken many passes to get the main roads bare and wet, which is a priority before moving to residential areas. Your neighborhood has probably only had one pass, and except for a thin layer, the bulk of the snow has been removed. It has also been sanded and can be navigated safely if you drive in a prudent manner.

8. What products does the city use to combat the snow and ice?

The city uses a one-to-one ratio of salt / sand mixture. We also use calcium chloride with Boost. Both of these are industry standards and environmentally friendly.

9. My sidewalk needs to be shoveled. When will you be here to do that?

Unfortunately, the city does not have the available resources to clear sidewalks. Adjacent property owners are responsible for clearing snow off the sidewalk.

10. When do you sand?

Sand and/or salt is used in combination with plowing to provide reasonable driving surfaces in icy conditions. Spot sanding will be done at specific locations on primary and secondary routes, as requested, and as time permits.

11. How do you select which streets to overlay?

The City of Federal Way follows a consistent practice of evaluating road surfaces and prioritizing what gets overlaid in any given year. The city selects which streets will be overlaid based on the Pavement Condition Index (PCI) rating, which is measured annually by an independent consultant. The streets have ratings from 0 to 100, where 100 is new / excellent pavement. The streets are grouped into cohesive areas to maximize the cost effectiveness of the project. 12. Why isn’t the overlay project work done at night to avoid traffic congestion?

The city has looked at every situation to determine if night work is feasible. If an arterial street is in a business or commercial area, the city will schedule the work at night to avoid impacts to businesses and traffic. Based upon past practice, if the arterial street is in a residential zone, the impact to this area (noise from construction equipment - grinders and vibratory compactors) is severe and generates numerous complaints from residents, therefore overriding the issue of traffic congestion.

13. When will my street will get overlaid?

The city selects streets to be overlaid based on the lowest Pavement Condition Index (PCI) ratings in the Pavement Management Systems (PMS) report and the available budget in the program. City staff prioritizes all street pavement conditions and available budget for that given year before a list is compiled and presented as a recommendation to the City Council. 14. Why did the sweeper go by on my street, but not come back up the other side?

That would mean that either the sweeper was full and needed to be dumped, or it was the end of the driver's shift. In either case, the driver will resume where they left off the next time they're in town.

15. Can the city post No Parking signs on the day before the sweeper is scheduled?

The sweeping schedule differs from month to month as to the exact day the sweeper will be there. The city does not have the resources to place signage on all of the streets that would be swept and/or relocate the signs from day to day.

2. What gives a public agency or a utility the right to dig up my front yard?

Public agencies and utility companies have the right to work in your front yard, provided the work stays within the right of way area. Right of way lines are often behind the actual roadway and sidewalks into what appears to be private property. At no time can a public agency work on private property without first obtaining consent from the property owner.

3. Do I need a right of way permit to install a culvert or fill a ditch in front of my property?

Yes. The ditch will be evaluated by the surface water staff to see if it meets the criteria for a storm conveyance system. If approved, you may apply for a right of way permit to perform the work. Right of Way Permit Application

4. Can I get a right of way permit to place a dumpster on the street in front of my home?

No. They must be placed in your driveway or yard. The large metal containers and dumpsters are not licensed vehicles and cannot be dropped in the street. Dumpsters often block sight distance and do not have reflectors, therefore posing a hazard to pedestrians and vehicles. In addition, the metal feet on the dumpsters can gouge the asphalt, shortening the roadway life span.

6. Do I need a right of way permit to repair my driveway or the sidewalk in front of my home?

Yes, a right of way permit is required for any repair of driveway or sidewalk in the right of way. Right of Way Permit Application

7. Do I need a right of way permit to maintain the right of way landscape adjacent to my property?

A permit is not needed for maintaining existing landscape, such as mowing and weeding. Modifications such as replanting or irrigation require a right of way permit. Right of Way Permit Application

8. Do I need a right of way permit to install a fence at the back of the sidewalk?

The back of the sidewalk may not be your property line. Fences must be installed on the property line. A right of way permit may be required if you need to perform the construction or operate equipment in the right of way for the installation of the fence. Right of Way Permit Application

9. Do I need a right of way permit to install a rockery or retaining wall in the right of way?

Yes. All work in the right of way requires a permit. A rockery or wall must be installed on the property line, but a right of way permit may be required if you need to perform the construction or store materials and equipment in the right of way. 10. How long does it take to get a right of way permit issued?

The average processing time is two weeks, but may be more or less depending on current staff workload.

11. Are there any time restrictions for lane closures in the right of way?

Approved hours for lane closures on collector and arterial streets are 8:30 am to 3:00 pm. Lane closures may be allowed earlier or later on residential streets with low traffic volume.

12. Are there any restrictions for days / hours when work can be performed in the right of way?

Approved hours of construction in the right of way are 7:00 am to 3:30 pm, Monday through Friday. Extended hours or work on a Saturday may be approved by the public works director, based on inspector availability, and this work is subject to overtime charges. Work cannot be performed at night, on Sundays or on observed city holidays without written approval from the director of community development.

Public Works - Street Systems Capital Projects

1. How does the City of Federal Way plan for future transportation improvements projects?

The city has a long-range planning process it uses to identify safety, capacity and pavement preservation needs. The city uses a travel demand model to project future traffic demand and plan for street improvements to accommodate that traffic.

2. Who pays for transportation improvements projects?

The city funds street capacity and safety improvements through a combination of city funds, developer fees, and grants funding. The city is very active in procuring state and federal grants funding to help pay for transportation improvement projects. Historically, about half of safety and capacity improvement funding has come from state and federal competitive grants.

3. Why is the city spending money on construction projects when there is a budget shortfall?

The main reasons the city performs construction projects even when we are going through a budget shortfall are based on the division of funding within the city, grant funding for capital projects and requirements of city codes. The city’s budget is divided into a general fund and capital fund. There are certain funding sources that by law can only be spent on capital projects, such as Real Estate Excise Tax, the city’s allocation of gas tax and mitigation funds the city receives from development activities. As these funds can only be spent on capital projects, such as road construction, they cannot be used to shore up shortfalls in the General fund. The city has also been awarded grants for many of our capital projects. Grant funding is specified for a single use, such as a street construction project, as and as such can only be used for that project. With some projects receiving multiple grants, funding levels on projects can vary up to 100% of the construction cost, so some large projects have very little impact on the city’s budget. The city code also has a “Concurrency” requirement that is mandated by the state. This requires the city to maintain minimum traffic standards for congestions. Without investment in capital projects, such as street improvements and traffic signals, the city would not be able to maintain these mandated standards, and congestion would worsen in the city and would be in violation of city and state law.

4. Why are there projects occurring on different streets at the same time, which impact alternative routes through the city?

The city tries to coordinate work on city streets to avoid work on alternative routes, such as two east west arterial streets, as much as possible. The city has delayed construction on some Capital projects up to a year to avoid this situation. In some cases there are multiple projects taking place within the city that make this situation unavoidable. A part of the problem is that the construction window for paving is between April and October, and weather can shorten this window even further. This situation typically occurs between a capital project and a portion of the city overlay project. Capital project scheduling is usually done over a process that can take up to four years to design and construct, and with funding requirements, need to be completed within a specific timeframe. In the interim the city is also managing the pavement condition of all the city streets. When an arterial street requires overlay, it is least costly and least time consuming to perform this work as early as possible, so the street does not deteriorate further over time. If a capital project on one street has been scheduled and a parallel street requires overlay, the city has to weigh the impact to traffic against the cost to delay the overlay. As overlay projects on specific roads usually take much less time than a project that requires widening, the city will sometimes make the decision to perform the work to avoid higher future costs of delay.

Public Works - Surface Water Management

1. I have a drainage ditch in front of my property and would like to fill it in. Who do I call?

You may call the Public Works Department at (253) 835-2700. Any construction activities in the City right-of-way, such as the installation of a catch basin and pipe in a ditch, require the issuance of a permit. The City currently references an established set of criteria pertaining to ditches when evaluating permit requests which include such questions as:

· Is there evidence of significant soil erosion?
· Does the ditch present a hazard to pedestrians or vehicles?
· Is there a chronic litter or debris problem?
· Can the existing grade and invert elevations accommodate pipe and catch basins?

Each request will be evaluated on a case-by-case basis and a recommendation will be made to the Public Works permit specialists. If approved, you will be required to submit a design observing established City construction codes and pay the appropriate permit fee.

2. How often does the City maintain retention/detention (R/D) ponds?

The current service level is to mow each of the City's 204 residential R/D ponds and facilities three times each year. The first round of mowing generally occurs in late April, the second mid-summer, and the final mowing of the year takes place in mid-September.

3. There are a couple of catch basin grates missing in my neighborhood. Who should I call?

Missing catch basin grates present a significant hazard to pedestrians and vehicles. Please report any missing or broken grates immediately to the Public Works Dept at (253) 835-2700 during the regular business hours of 8 AM to 5 PM and to the City's After Hours Callout Service at 1-800-400-0749 on weeknights, weekends, and on observed holidays.

4. I have a leak in my water service. Should I call the City?

No. The City of Federal Way is not associated with the two water districts currently providing water and sewer service within the City. Please refer to your water and sewer bill to determine your provider and contact them as appropriate. The Lake haven Utility District may be reached at (253) 941-1516 and the Tacoma Public Water Utility can be contacted at (253) 502-8000.

5. If I call the City with a complaint, when should I expect a response?

It is the practice of the SWM Maintenance Division to make every effort to respond to Citizen Action Requests (CARs) within 24 hours of receipt.

6. My neighbor has redirected water onto my property. What can the City do to help?

Please contact the Public Works Department at (253) 835-2700. While matters such as this are generally civil in nature, a representative from Surface Water Management will conduct an inspection of your property and may act in an advisory capacity to assist you with possible solutions to the problem. A Code and Compliance Officer may also be contacted to investigate any potential code violations pertaining to the flooding.

7. I have a City drainage easement on my property. What does that mean?

An easement is defined as a space or corridor on a property wherein a public or private entity or utility is granted the legal right of entry to maintain specific infrastructure such as a stream, drain pipe, power/gas line, phone cable, etc. Many different types of easements exist and for many different reasons, but be aware that the existence of a City drainage easement on your property does not imply City ownership of the property. Rather, the City will only maintain the drainage infrastructure (usually catch basins, pipes, and ditches) as specified in the easement provisions and is generally not responsible for any landscaping or mowing. As a rule, SWM staff will make every effort to notify the owner before entering the property to conduct an inspection of an easement.

8. Can the City's surface water R/D facilities be used for recreation?

Unless posted otherwise it is generally not permitted for many reasons. For example, water can present a drowning hazard, rocky areas can lead to trips and falls, litter from recreation activities can plug off pipes, and deep control manholes can result in falls not to mention potential asphyxia. Public R/D facilities are designated and designed for the sole purpose of containing and controlling surface water runoff not recreation. If you notice an unlocked gate or unsecured access point, please contact the Public Works Department at (253) 835-2700.

9. Someone dumped paint into the catch basin near my home. Is that okay or should I call the City?

The dumping of any water or oil based paints or any other contaminants into a catch basin is illegal and should be reported immediately to the Public Works Department at (253) 835-2700 or to the after-hours callout service after 5 PM at 1-800-400-0749. A SWM staff member will investigate to determine the source of the paint or other contaminant and will take measures to remove the material from the catch basin and pipes.

10. Will the City spray our neighborhood R/D pond for mosquitoes?

No. It is the current City policy not to treat any ponds, streams, lakes, wetland areas, or other bodies of water with pesticides. 11. I have a lot of water in my crawl space. Can the City do anything to help?

Yes. Upon receipt of your request, SWM staff will contact you to schedule an inspection of your property and the surrounding area. Most water in the crawl space issues are related to a persistent ground water problem exacerbated by such things as a plugged foundation drain, cracks in the foundation, and/or surface draining downspouts. The City does not conduct any maintenance or construction activities on private property and will only act in an advisory capacity.

12. Can you recommend a good drainage contractor?

Generally speaking, no. To avoid any appearance of impropriety or favoritism, SWM staff prefers not to make any recommendation of specific contractors. A good start is to reference the headings of "drainage" or "landscaping" in your phone book. Be sure to solicit at least three to five bids and check contractor references before the acceptance of any bids.

13. There are leaves covering the drain in the street. Who should I call?

You may contact the Public Works Department during the daily business hours of 8 AM to 5 PM at (253) 835-2700 or on weeknights, weekends, and observed holidays at the Public Works After Hours Callout Service at 1-800-400-0749. Maintenance staff or a street sweeper will be dispatched to remove the leaves and debris. If you are so inclined, feel free to remove the leaves yourself-not only is it good exercise but is of great assistance, especially in the fall months, to field maintenance crews charged with the maintenance of about 12,000 catch basins.

14. Does the City maintain the retention/detention (R/D) pond in my neighborhood?

Most likely. Most open R/D facilities in residential neighborhoods are maintained by the City although exceptions do exist, particularly those located near streets designated as private or in plats where the ponds were never legally dedicated to the City of Federal Way after incorporation in February of 1990 or King County prior to that time. To obtain maintenance responsibility information on the pond in your neighborhood, please contact the SWM Maintenance Supervisor at (253) 835-2755.

4. What do you offer for seniors?

5. What do you offer for preschool-aged children?

We offer toddler play groups on Monday through Friday from 9:30 am to 11:30 am with a drop-in fee. We have morning and afternoon preschool classes one, two or three days a week for 3-5 year-olds. Fridays, we offer Alphabet Express for 2-4 year-olds (parent participation required).

6. What age can my kids start using the fitness area?

Once your kids are 12, they can begin to have limited use of the fitness area once they have completed a junior fitness orientation. At age 15, there are no restrictions. Children ages 9 and above are allowed to use the track with parent supervision all hours except 5:00 pm to 7:00 pm, Monday through Friday (adult-only hours).

7. Are the group fitness classes included in the membership?

Yes. We offer nearly 30 classes each week. Group Power is our weight lifting class, Group Centergy is a pilates / yoga class, Group Kick is kickboxing, Group Step is aerobics. We also offer dance-based classes Jazzercize and Zumba. Please check out our Fitness Class schedule in the PRCS catalog or visit the Federal Way Community Center website.

8. What are the climbing pinnacle hours?

9. I'm just returning to fitness and not sure where to start. What services do you guys offer to get me orientated with the facility?

If you need an equipment orientation, then that is offered on Tuesdays at 9:30 am, Wednesdays at 7:00 pm and Thursdays at 4:00 pm. This class is free to members and day pass users.

10. How old does my child have to be to be in the pool by themselves?

All children 6 years of age and younger must be accompanied by an adult (16 years of age or older) in the water and that adult must be within arms reach of the child at all times.

11. How tall must my child be to use the large slide in the Leisure Pool?

All riders of the big slide must be at least 48 inches tall. They must ride the slide feet first on their back or bottom and may not use any kind of life jacket or floatation device.

12. Does my child have to wear a swim diaper?

If the child is 3 years of age and under, it is required that the child uses an approved swim diaper while using the facility. Diapers other than swim diapers tend to leak when placed in a swimming pool.

13. How old does my child have to be to safely use the spa?

The Washington State Health Department recommends that no child under the age of 6 use the spa due to health concerns arising from overheating. No one wearing diapers of any type are allowed in the spa. Therefore no child 3 years of age or younger may use the spa.

14. What is the difference between Water Walking and Channel Walking?

Channel Walking is an instructor-led exercise course that involves walking against the current in the Lazy River. Water Walking is a time for patrons to use the Leisure Pool to exercise at their own pace or to use the various pieces of exercise equipment that the facility has to offer.

1. Do I need a sign permit for my business sign?

Yes. Any new or refaced sign requires a permit.

2. How big of a sign can I put up for my business?

The size allowance for a business sign is based on the size of building or suite facade for that business. View the Federal Way Revised Code for information on the size and number of signs a business is entitled to.

3. Can I put a sign on a sidewalk or other part of a right-of way?

All private signs are prohibited in public right of ways, except for portable signs. View information on portable signs. Find help in determining allowable locations for portable signs.

Utility Tax Rebate Program

1. What is the definition of senior?

Senior is defined as anyone over the age of 65.

2. What is the definition of disabled?

Disabled is defined as someone who is unable to maintain gainful employment because of his/her physical or mental disability. SSI, SSD, VA or L and I disabilities are accepted. Proof of disability is required.

3. Why do I need full copies of all my bills?

Our refunds are based on actual usage so we must see the entire bill to calculate the refund.

4. My utility company just sent me a statement of charges. Will this work?

Unfortunately, no. We need to see full bills.

5. For which utilities can I get a refund?

Power, home phone, cell phone (with contract), Waste Management and cable utilities are eligible. Prepaid cell phones and satellite TV service do not collect utility tax. We do not accept third-party billers for garbage.
